1. General provisions

1.1. These terms set out the rules for using the Faktuwa service available at [DOMENA] (hereinafter: "the Service"), including the free beta version and the paid conversion packs.

1.2. The service provider is [DANE PODMIOTU], [ADRES SIEDZIBY], NIP [NIP], REGON [REGON], [KRS lub CEIDG] [NUMER], email: [E-MAIL KONTAKTOWY].

1.3. The terms are provided free of charge on the site before a contract is concluded, and you may save and download them.

1.4. The Service is intended to convert an invoice file (PDF or image) into an XML file that conforms to the FA(3) schema set by the Ministry of Finance, for use in KSeF. The Service is not meant to send any data to the national e-invoicing system (Krajowy System e-Faktur, KSeF) or to the Ministry of Finance. You send the XML file yourself.

1.5. The Service is not connected with the Ministry of Finance or with the National Revenue Administration (Krajowa Administracja Skarbowa, KAS).

1.6. The Service is intended only for people in the territory of Poland.

2. Definitions

• Consumer: a natural person who enters into a legal transaction not directly connected with their business or professional activity.

• Entrepreneur: a person running a business who buys the Service within the scope of that business.

• Beta: the free version of the Service with a conversion limit, which may include restrictions and changes.

• Pack: a paid set of conversions (planned: 50 conversions for [CENA] PLN incl. VAT).

3. Beta version (free)

3.1. In the beta version, each user may make up to 3 free conversions a month per browser.

3.2. The limit is counted on the basis of a token in the browser and a hash of the IP address in a network prefix. Clearing the browser data resets the token counter. The limit may also be restricted at network level.

3.3. The beta version is provided "as is" and may be changed, suspended or ended at any time. We do not guarantee continuity or availability.

3.4. The beta version may be temporarily suspended if the total cost of the Service exceeds a threshold set by the service provider.

4. Rules of use

4.1. When using the Service, you send only invoices that you are entitled to process. Do not send special category data or unnecessary personal data.

4.2. It is prohibited to use the Service in a way that disrupts it, gets around the limits, automates requests without consent, or breaks the law.

4.3. The Service does not replace an accountant or a tax adviser.

5. Prices and payments (paid pack)

5.1. Prices are given in Polish zloty (PLN), gross, include VAT at the rate of [STAWKA VAT], and are shown before purchase.

5.2. Payments are handled by Stripe. Stripe's payment terms apply to the payments.

5.3. The pack is activated after the payment is posted and has no expiry date.

5.4. Price reductions: if a price is reduced, we will show the lowest price from the 30 days before the reduction.

6. Withdrawal from the contract (consumer)

6.1. A consumer who has concluded a distance contract may withdraw from it without giving a reason within 14 days of the date the contract was concluded.

6.2. To exercise the right of withdrawal, send a statement to [E-MAIL KONTAKTOWY]. You may use the withdrawal form template (annex no. [NUMER ZAŁĄCZNIKA]).

6.3. Digital content. The right of withdrawal does not apply to digital content not supplied on a tangible medium if performance began with your express consent before the withdrawal period ended and after we informed you that you would lose your right of withdrawal.

Before a pack is purchased, we will show a checkbox with the following text: "I consent to the immediate performance of the service before the 14-day period ends, and I acknowledge that in this way I lose my right to withdraw from the contract."

6.4. After purchase, we send a confirmation of the contract and of your consent on a durable medium (email).

7. Withdrawal by an entrepreneur (sole trader buying for business purposes)

7.1. The consumer rights rules do not apply to an entrepreneur buying the Service within the scope of their business.

7.2. The withdrawal right that arises under the consumer regime does not apply to an entrepreneur.

8. Complaints

8.1. We accept complaints at [E-MAIL KONTAKTOWY] within [TERMIN] of discovering the defect. We reply within [TERMIN] days.

8.2. Before sending the XML file to KSeF, you must check the fields on the "Review and correct" screen. You are responsible for the data meeting legal requirements and matching the actual invoice.
